Resting on a team with extensive and solid experience in the energy sector, particularly in electricity, LEXT supports many of its private-sector clients in Africa on electricity generation projects (both greenfield and brownfield) involving hydroelectric, wind, solar or thermal power, as well as energy storage projects. LEXT also supports African public sector entities, in both generation and transmission.

In addition to project developers and public bodies, LEXT’s clients include manufacturers involved in the development of electricity supply solutions, companies developing off-grid electricity access solutions, and sector subcontractors (suppliers and service providers).

LEXT’s expertise covers all legal aspects:

  • Analysis of electricity sector regulations relating to transmission, generation and distribution;
  • Draft and negotiation of the project documents (concession agreements, power purchase agreements, JDA, EPC contracts, O&M contracts, BoP contracts, direct agreements);
  • Negotiation of the project documents with the LLA;
  • Draft and negotiation of turbines or engines supply agreements;
  • Draft and negotiation of power lease agreements;
  • Permitting relating to land, construction, utility lines, town planning, water supply, commissioning, etc.
  • Draft of tender rules or support with tender responses;
  • Draft of connection and grid access agreements;
  • Legal due diligence for the acquisition of electricity generation projects.
